The Premier Sports Platform Connecting Talent to Opportunity

CODE OF CONDUCT

(Scouts, Agents, Coaches, Clubs, Directors, Academies & Schools)

This Professional User Code of Conduct (“Code”) applies to all Professional Users of the BESEIN Services, including scouts, agents, coaches, club and academy staff, school staff and other professionals (“Professional Users”). It forms part of, and is incorporated into, the BESEIN Terms of Use. In the event of any conflict, the Terms of Use prevail for legal interpretation.

By registering or using a Professional User account, you agree to comply with this Code in addition to the Terms of Use and Privacy Policy. This Code does not constitute a professional licence, certification or accreditation, and compliance with this Code is not a guarantee by BESEIN that a Professional User is suitably qualified or fit for any particular purpose.

Purpose and General Principles

BESEIN is designed to support fair, transparent, and development-focused talent identification and evaluation in football. Professional Users are expected to act with integrity, respect and professionalism at all times when using the Services or engaging with Players, Parents or Guardians and Partner Organisations through the Services.

You acknowledge that a significant proportion of Players using BESEIN may be minors and that, where minors are involved, your conduct must reflect the heightened standards applicable to working with young people, including compliance with applicable safeguarding, child protection and anti-discrimination laws, and with any codes of conduct imposed by your club, academy, school or governing body.

Safeguarding, Respect and Player Welfare

You must treat all Players and Parents or Guardians with respect and must not engage in any form of bullying, harassment, intimidation, degrading treatment or abuse, whether verbal, written, visual or otherwise.

You must not use BESEIN or information obtained through the Services to groom, exploit or attempt to groom or exploit any Player, including minors. This includes, without limitation, seeking inappropriate personal relationships, requesting or sending sexual content, or encouraging secrecy from Parents or Guardians.

You must comply with any communication rules or restrictions implemented by BESEIN to protect minors, which may include:

  • - limits on direct messaging with Players under a certain age;
  • - requirements to include Parents or Guardians in communications; or
  • - routing contact through clubs, academies or Partner Organisations.

You must not encourage Players to undertake training, testing or match activities that are clearly unsafe for their age, physical condition or context. AI Outputs, performance metrics and comparisons must not be used in a manner that encourages self-harm, extreme overtraining or risk-taking behaviour.

Nothing in this Code is intended to require Professional Users to provide medical advice or to act as medical professionals. Professional Users remain responsible for operating within the limits of their training and qualifications and must refer Players to appropriate medical or allied health professionals where there are concerns about injury, illness or fitness to participate.

Anti-Discrimination and Fair Use of Data

You must comply with all applicable equality, anti-discrimination and human rights laws in your jurisdiction.

You must not use BESEIN, including any data, metrics or AI Outputs, to engage in unlawful discrimination or to make decisions based on protected characteristics, such as race, colour, ethnic or national origin, religion, sex, gender, disability or similar protected status under applicable law.

You understand that BESEIN’s AI systems are designed to interpret football actions and generate performance data and insights based on observable play, not to evaluate a person’s worth, character or off-field identity. It is your responsibility to ensure that any scouting or selection decisions you make are fair, holistic and compliant with applicable law and your own organisation’s policies.

Appropriate Use of BESEIN and Player Data

You must use BESEIN and any Player data obtained through the Services solely for legitimate football-related purposes, such as talent identification, recruitment, performance analysis and player development within the scope of your professional role.

You must not:

  • - scrape, harvest or systematically download Player profiles, videos or data to create an independent database;
  • - sell, rent, license or otherwise commercially exploit Player data outside of your legitimate role;
  • - share Player data with unauthorised third parties; or
  • - use Player data for general marketing or unrelated commercial purposes.

You must handle all Player data in accordance with applicable data protection and privacy laws and with any confidentiality obligations imposed by your employer or governing bodies. Where required, you must ensure you have a lawful basis to process Player data in your own systems (for example, with your club’s Data Protection Officer).

If you export or download copies of Player Media or data (where permitted by the Services), you are responsible for securing those copies and for deleting them when they are no longer needed, in accordance with your organisation’s policies and applicable law.

Communications and Contact Boundaries

You must only contact Players or Parents or Guardians through channels and in a manner that is appropriate, professional and consistent with safeguarding standards.

You must not pressure Players or Parents or Guardians into decisions about trials, representation, contracts, scholarships or similar opportunities. You should provide clear, accurate information and reasonable time for consideration.

You must not represent that an opportunity is endorsed by BESEIN or that BESEIN guarantees any outcome. BESEIN does not act as a party to player contracts, trials or representation agreements.

Professional Users must not seek to move communications with minors into private, unsupervised channels (online or offline) in a manner that is inconsistent with their organisation’s safeguarding policies or applicable law. Where minors are involved, Professional Users should, wherever practicable, ensure that Parents or Guardians, clubs, academies or schools are aware of and, where required, involved in communications and invitations.

Authenticity, Honesty and Conflicts of Interest

You must be truthful about your identity, role, club/academy affiliation and authority when using the Services or interacting with Players and Parents or Guardians. You must not impersonate another person or misrepresent your relationship with any club, academy or organisation.

You must not knowingly misrepresent the level, competition or context of any opportunity you offer to a Player, nor create false expectations regarding professional contracts, scholarships or trials.

You must disclose and appropriately manage any conflicts of interest in accordance with your organisation’s policies and applicable law, including situations where you may stand to gain personally from a Player’s transfer, contract or representation.

Compliance, Reporting and Cooperation

You must promptly notify BESEIN if you become aware of:

  • - User Content or behaviour on the Services that appears to exploit, endanger or otherwise harm a Player, especially a minor;
  • - any actual or suspected breach of this Code by another Professional User; or - any misuse of BESEIN data or features.

You agree to cooperate reasonably with BESEIN in any investigation of potential breaches of this Code or the Terms of Use, including by providing relevant information (subject to applicable law and confidentiality obligations).

BESEIN may, at its discretion and in accordance with applicable law:

  • - review and investigate reported concerns;
  • - remove or restrict access to content;
  • - suspend or terminate Professional User accounts;
  • - notify relevant clubs, academies, schools or employers; and/or
  • - report matters to law enforcement or child protection authorities where we reasonably believe there is a risk of harm or unlawful conduct.

Professional Users remain responsible for complying with the safeguarding, child protection and reporting procedures of their own clubs, academies, schools, associations and governing bodies. Reporting a concern to BESEIN does not replace or satisfy any legal or organisational obligation you may have to report concerns internally or to external authorities.

Consequences of Breach

Any breach of this Code may result in suspension or termination of your Professional User account, restriction of features, notification to your club, academy, school or employer, and/or other action permitted under the Terms of Use and applicable law.

Nothing in this Code limits BESEIN’s rights under the Terms of Use or any separate agreement with you or your organisation, and BESEIN may exercise all rights and remedies available to it at law or in equity.

Updates to this Code

BESEIN may amend or update this Code from time to time to reflect changes in the Services, legal requirements or best practice in safeguarding and professional conduct. Where we make material changes, we will update the “Effective Date” above and may provide additional notice to Professional Users.

Your continued use of a Professional User account after any updated Code becomes effective constitutes your acceptance of the updated Code. If you do not agree, you must cease using the Professional User features of the Services.

No Third-Party Rights

This Code is agreed between BESEIN and Professional Users. It does not create any contractual or other right for Players, Parents or Guardians or any other third party to enforce its terms directly against BESEIN. BESEIN’s decisions about how to respond to alleged breaches of this Code are matters for BESEIN’s discretion, subject to applicable law.
